Shein Faces Growing Scrutiny as Copyright Disputes Continue Across the Fashion Industry

Scroll through social media for a few minutes, and chances are you’ll come across someone accusing Shein of copying a designer’s work. Over the past several years, the ultra-fast fashion giant has become one of the most controversial companies in the industry because of repeated claims that it sells products resembling original creations from independent artists, small fashion labels, and established brands. Shein says it respects intellectual property and pulls infringing items once it’s talked about them, but the lawsuits and complaints keep piling up, so the controversy hasn’t gone anywhere.

Critics say Shein’s whole business model leans on speed, data, and tech working together in a way older fashion companies just can’t keep up with. Legal reviews and investigations point to the company using algorithms that track rising trends on social media, viral fashion looks, and pieces made by independent designers, which helps it spot styles right as they start catching on. There are also reports that AI tools pull publicly posted images from places like Instagram and fashion sites, going through original indie clothing, artwork, and runway pieces before knockoffs even show up for sale. Once something’s been flagged as worth copying, Shein’s massive supplier base in China can reportedly get samples made, start production, and have finished items listed for sale in about 10 days — making it one of the fastest turnaround times anywhere in fashion.

Designers worry shoppers might buy a cheap knockoff without realizing it, end up unhappy with the quality, and mistakenly blame the original brand for it — chipping away at a reputation built over years. A lot of artists also say the constant copying kills motivation to create, since pouring months into a new collection feels pointless when it could be copied almost overnight.

Legal experts point out this kind of speed doesn’t leave much room for real intellectual property checks before products hit the market. And since copyright lawsuits cost a lot of money and take forever, many smaller creators simply can’t afford to fight back, especially against a company this size. Even when a case does succeed, pulling down one copied item barely makes a dent if similar knockoffs keep popping up somewhere else — which says a lot about how weak intellectual property enforcement really is in fast fashion right now.

Shein is fighting off plenty of its own copyright lawsuits, but ironically enough, it’s also filed one of its own — suing Temu in the UK High Court, accusing the company of stealing thousands of Shein’s product photos. It’s a pretty telling example of just how tangled up intellectual property fights have become in ultra-fast fashion.

There’s a bigger picture behind the Shein controversy than just how one company operates — it forces a hard conversation about protecting creativity at a time when AI and ultra-fast manufacturing make copying easier than ever. As the tech keeps improving at spotting trends and reproducing designs almost instantly, lawmakers, online marketplaces, and fashion companies will likely have to deal with growing pressure to tighten up intellectual property enforcement. Until that actually happens, independent designers are left trying to stay creative while knowing their next hit design could get copied almost as fast as it goes viral in the first place.
